DMCA Notice and Takedown Policy

GoBlacked.com complies with the Notice and Takedown requirements of 17 U.S.C. § 512 of the Digital Millennium Copyright Act (“DMCA”). DMCA Safe Harbor: As a Service Provider under the DMCA, Go Blacked qualifies for specific protections against copyright infringement claims under the “safe harbor” provisions.

We are committed to respecting the intellectual property rights of others and complying with applicable laws. This DMCA Policy outlines the process by which copyright owners can notify us of alleged infringements and how we handle those notifications.

Notice of Claimed Infringement

Reporting Copyright Infringement: If someone reproduces, distributes, displays, or otherwise uses your copyrighted work on Go Blacked without authorization, follow the procedure below to report the infringement. We require that you provide us with a detailed notice containing the following information:

  1. Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
  2. Description of the Work: A description of the copyrighted work or other intellectual property that you claim has been infringed. Please be specific about what you believe has been infringed.
  3. Location of the Infringing Material: A description of the location of the infringing material on GoBlacked.com (i.e., the URL or other identifying details that allow us to locate the material). This should be precise enough for us to identify the content.
  4. Your Contact Information: Provide your address, telephone number, and email so we can reach you for further correspondence.
  5. Statement of Good Faith Belief: You affirm that you genuinely believe the disputed use does not have authorization from the copyright owner, their agent, or the law. This should explain why you believe the content is infringing.
  6. Statement of Accuracy: You declare under penalty of perjury that the information in your notice is accurate and that you either own the copyright or intellectual property or have authorization to act on the owner’s behalf.

Once we receive a proper DMCA Notice, we will review it and, if appropriate, remove or disable access to the allegedly infringing content.

Take Down Procedure

Upon receiving a valid DMCA Takedown Notice, GoBlacked.com will act expeditiously to remove or disable access to the content identified in the notice. We take claims of copyright infringement seriously and make every effort to respond promptly.

Copyright Enforcement: Go Blacked may remove or disable access to any content alleged to infringe on others’ copyrights. If we confirm the infringement, we remove the content from the platform promptly.

Repeat Infringers

As part of our DMCA Compliance, we have a policy to terminate the accounts of users who repeatedly infringe upon the copyrights of others. If a user is determined to have infringed multiple times, GoBlacked.com may suspend or permanently ban their account.

Copyright Protection: This process protects copyright owners’ rights and prevents unlawful distribution of copyrighted material on our platform. In line with the DMCA, we notify the user whose content we remove or disable.

Counter-Notification

Counter-Notification: You may file a Counter-Notification with Go Blacked if you think we removed content in error or misidentified your material. Your Counter-Notification should include:

  1. Identification of the Content: A description of the content that was removed and the URL or other location where it appeared before removal.
  2. Statement of Good Faith Belief: A statement that you have a good faith belief that the content was removed as a result of a mistake or misidentification.
  3. Your Contact Information: Your full name, address, telephone number, and email address.
  4. Consent to Jurisdiction: A statement consenting to the jurisdiction of the federal court located in Puerto Rico and that you will accept service of process from the person who submitted the original DMCA Takedown Notice.
  5. Signature: Your physical or electronic signature.

Once we receive your Counter-Notification, we will restore the content unless the original complainant files a court action to prevent the reinstatement of the material.

Limitation of Liability

In compliance with the Digital Millennium Copyright Act and the safe harbor provisions provided under 17 U.S.C. § 512, GoBlacked.com is not liable for any infringement claims resulting from user-uploaded content. Our platform is a service provider that acts as an intermediary and, as such, qualifies for the protections under the DMCA‘s safe harbor provisions.

We do not actively monitor or screen the content uploaded by our users, but we respond promptly to valid DMCA Notices and take down infringing content as required by law.
